{"id":15214,"date":"2019-12-05T00:00:00","date_gmt":"2019-12-05T00:00:00","guid":{"rendered":"https:\/\/clearway.vanillabeancreative.com\/news\/under-what-circumstances-can-a-landlord-enter-a-property-that-is-under-lease\/"},"modified":"2024-04-05T11:14:55","modified_gmt":"2024-04-05T11:14:55","slug":"under-what-circumstances-can-a-landlord-enter-a-property-that-is-under-lease","status":"publish","type":"post","link":"https:\/\/www.clearway.co.uk\/news\/under-what-circumstances-can-a-landlord-enter-a-property-that-is-under-lease\/","title":{"rendered":"Can a landlord enter a property that is under lease?"},"content":{"rendered":"<p><strong>Many landlords mistakenly believe that because they own a property, they have a right to enter it as and when they wish.<\/strong><\/p>\n<p>To avoid breaking the law, landlords should not enter a property that they are renting out without the express permission of their tenant.<\/p>\n<p>Although the landlord owns the property, whilst the tenant is leasing it, they have the right to live in the property undisturbed.<\/p>\n<p>Landlords that enter a property without the permission of their tenant could even find themselves facing prosecution for harassment under the Protection from Eviction Act 1977.<\/p>\n<p><strong>When can a landlord legally enter a property under lease?<\/strong><\/p>\n<ul>\n<li><strong>With the tenant\u2019s permission<\/strong>\u00a0\u2013 Landlords may enter a property providing they have given the tenant at least 24 hours\u2019 notice and the tenant has granted them permission to do so.<\/li>\n<li><strong>When granted permission by the courts\u00a0<\/strong>\u2013 In certain circumstances, if your tenant is unreasonably refusing you access, you may be able to apply to the court for an injunction to gain permission to enter the property.<\/li>\n<li><strong>Emergencies \u2013\u00a0<\/strong>In the event of an emergency such as a fire, gas leak, flooding or urgent structural damage, the landlord may enter the property without first obtaining permission.<\/li>\n<\/ul>\n<p>If none of the above conditions have been met, then the tenant is within their rights to refuse the landlord entry.<\/p>\n<p>Landlords have been known to try to add a clause to the tenancy agreement that states that they are allowed access to the property at any time.
